Litigation (Trials and Alternative Dispute Resolution)

Our attorneys have built a reputation for excellence in assisting clients in resolving their claims for injuries or damages through negotiation, dispute resolution techniques such as mediation and arbitration, administrative hearings and courtroom trials.   • Business and Corporate Matters – We handle virtually any kind of dispute involving commerce and business.   • Professional Malpractice – We routinely represent plaintiffs and defendants in malpractice litigation against professionals. We rely not only on our courtroom skills and experience in helping clients, but we also draw upon our broad knowledge of the standards and regulations that govern the underlying profession.
  • Trusts and Estates Litigation – We regularly represent executors, trustees, beneficiaries under trusts and wills, and persons with claims against a trust or an estate. We have substantial experience in prosecuting and defending will and trust contests, seeking court intervention in interpreting ambiguous provisions, prosecuting and defending claims for breach of fiduciary duty or asset mismanagement, and assisting with claims arising out of a decedent’s transactions with third-parties prior to death.
  • Real Estate – Our attorneys have deep experience in resolving disputes in such areas as zoning and other governmental land use disputes, condemnations, foreclosures, breach of real estate contracts, lease disputes, title issues, boundary disputes, and disputes among joint ventures or partners.
  • Condemnation – Our attorneys have represented individuals and businesses that have had lands taken by governmental and quasi-governmental entities for utilities, roadways and other public purposes, with such matters often involving a challenge to the taking or to the amount of compensation being offered for the property that has been taken.
  • Annexation – Our firm has developed a reputation throughout North Carolina in representing individuals and community groups opposing annexation by various municipalities.
  • Construction – Our attorneys have represented numerous clients in resolving disputes concerning construction projects, including disputes related to design and construction and disputes resulting from goods or services provided by suppliers and subcontractors.
  • Debt Collection and Creditor’s Rights – We have represented creditors, guarantors, lessors and equity security holders in both trial courts and bankruptcy courts in pursuing claims, defending claims and in addressing such matters as fraudulent conveyances, lien avoidances and preferential transfers.
