Trusts and Estates

Our trusts and estates attorneys assist clients with the design and implementation of estate plans and wealth transfer strategies and with the effective administration of trusts and estates. Some of the matters we are called upon to handle include the following:

  • Tailoring wills, revocable (living) trusts, general powers of attorney, health care powers of attorney and advance directives to the needs of the client and the client’s family.
  • Assisting with lifetime gifting techniques designed to save transfer taxes, including “Crummey” trusts, family limited partnerships and family limited liability companies, gifts and sales to intentionally defective grantor trusts, grantor retained annuity trusts, life insurance trusts, qualified personal residence trusts and qualified terminable interest property trusts.
  • Counseling clients in planning for the transfer of closely held business interests, family farms and other unique assets.
  • Negotiating and preparing premarital agreements.
  • In the administration of trusts and estates, preparing and filing court qualification documents for the probate of an estate, preparing and filing court inventories and accountings, coordinating the preparation and filing of estate tax returns and fiduciary income tax returns, counseling clients with post-mortem tax planning, such as disclaimers and various tax elections, and representing clients in audits of federal and state estate, gift and fiduciary income tax returns.
